Time Limits for Accident Victims
- Where the victim is an ADULT, the claim must be brought within 3 YEARS of the accident.
- Where the victim is a CHILD, the claim must be brought before the child reaches 21 YEARS OF AGE.
- Where the victim is MENTALLY INCAPACITATED, there may be NO TIME LIMIT on the claim, but you still should take action as soon as possible.
- In certain circumstances, claims may be brought outside the time limit with the permission of the court. So even if you think you are out of time we will give you specialist advice about whether you may claim.
